THE COURT: Okay. The record will reflect

Mr. Favish is present, as well as the government's

attorney. Thank you for your patience.

You've seen the preliminary ruling, Mr. Favish.

Effectively it goes against you for the reasons stated.

I certainly will listen to you regarding any points that

you wish to address that I have preliminarily ruled

upon, Mr. Favish.

MR. FAVISH: Thank you, your Honor.

By the way, I liked the part about the color

photographs. That was okay.

THE COURT: The best I can do, I think,

Mr. Favish.

MR. FAVISH: Well, I'm still wondering how we

can cite the Fiske and Starr reports, when Mr. Foster's

evidence we have, and his car was not in the park,

between 4:30 and shortly before 6:00 p.m.

THE COURT: I'm sorry. How do you differ with

my view? What is it that's wrong here?

MR. FAVISH: Well, on page 6 at the bottom --

THE COURT: Yes.
